The six-member full-bench of the Appellate Division headed by Chief Justice Md Muzammel Hossain however adjourned until January 24 the hearing on a petition filed by Ashiyan City seeking a stay on the HC order.
The court passed the order after Barrister Rokanuddin Mahmud, a counsel for Ashiyan City, sought an adjournment on the hearing of the stay petition.
He also sought permission from the apex court for allowing them to file before it a leave-to-appeal petition against the HC order on January 24.
Advocate Iqbal Kabir Lytton, a lawyer for the writ petitioners, told The Daily Star that the HC's January 2 order will remain in force until the Supreme Court passes a stay order on it.
Earlier on January 14, the SC's chamber judge Justice Syed Mahmud Hossain refused to stay the HC order following a petition filed by the real estate company on January 9.
On the same day, the judge sent the petition to the full bench of the apex court for its hearing on January 20.
Following a writ petition filed by eight rights organisations, the HC on January 2 issued the order against the realtor which took up the project in the capital's Holan and Ashkona on a conditional and partial approval from the Ministry of Housing and Public Works.
