Dhaka court on Thursday deferred until March 3 the hearing on charge
framing against BNP Chairperson Khaleda Zia and five others in
connection with Zia Orphanage Trust graft case.Anti-Corruption Commission filed the case with Ramna Police Station on July 3 in 2009 for embezzling over Tk 2.10 crore by forming the ‘fake’ trust.
Judge Md Mozzammel Hossain of Special Judge's Court-3 passed the order after advocate Sanaullah Mia, lawyer for Khaleda, submitted a petition seeking an adjournment of the hearing.
In the petition, Sanaullah told the court that Khaleda had earlier filed a writ petition with the High Court challenging the legality of the case.
The HC dismissed the writ petition on December 14, 2011.
Later, Khaleda filed a leave-to-appeal petition with the Appellate Division of the Supreme Court against the HC order, Sanaullah said.
The hearing on the leave to appeal petition remains pending with the SC and the hearing on it is scheduled to be held on March 3.
So, Khaleda prayed for time, Sanaullah added.
During Thursday's hearing the BNP chairperson did not appear before the court as she was taking preparation for attending the Jatiya Sangsad sessions scheduled to be started on January 27.
The other accused are: Khaleda's elder son Tarique Rahman, former principal secretary Dr Kamal Uddin Siddique, former BNP lawmaker Kazi Salimul Haque, businessman Sharfuddin Ahmed and Momenur Rahman, nephew of BNP founder Ziaur Rahman.
Of the five, Salimul and Sharfuddin were present at the court while Tarique is undergoing treatment abroad, and Kamal and Momenur are on the run.
