Dhaka, Oct 4 Forced to adjourn Jamaat-e-Islami Delwar Hossain Sayedee's trial due to unavailability of witnesses, the first war crimes tribunal ordered on Thursday that defence witness examination would be suspended if the defence did not have further witnesses ready on Sunday.
The three-judge International Crimes Tribunal – 1, that has indicted Sayedee for 20 war crimes charges, ordered that if the defence failed to bring further witness on Sunday (Oct 7), then the accused would be barred from bringing any more defence witnesses.
With the deposition and cross-examination of the eighth defence witness over within about 40 minutes, tribunal Chairman Jutice Mohammad Nizamul Huq asked Sayedee's defence to present their next witness.
The tribunal expressed its disapproval in so many words as senior defence counsel Mizanul Islam said he did not have further witnesses ready.
Justice Huq reminded the lawyer that he had cautioned the defence just a day before that they should not give the tribunal an opportunity to pass an adverse order.
The ultimatum caused another defence counsel Tajul Islam take the floor and urge that the tribunal refrain from issuing the stiff ultimatum in a heated bout of exchange.
Prosecutor Syed Haider Ali stood up to urge that the court stop further examination of any more defence witnesses at once.
