Dhaka, Oct 17 The High Court on Wednesday directed the police to produce before it on Thursday morning the physician who was remanded for allegedly threatening on Facebook Meher Afroz Shaon, widow of celebrated writer Humayun Ahmed.
The bench of Justice AHM Shamsuddin Chowdhury and Justice Farid Ahmed passed the order in response to a writ petition that challenged the legality of taking the accused in police custody on the basis of a general diary (GD).
Mohammad Akiluzzaman, brother of the Dr Ehsanuzzaman, filed the petition.
The Deputy Commissioner (DC) of Dhaka district, Inspector General of Police (IGP), Major Siddiqur Rahman of RAB-3 and Officer-In-Charge of the Ramna Police Station have been made respondents to the court order.
Barrister AKM Shafiuddin argued for the petitioner at the hearing while Deputy Attorney General Amit Talukder stood for the state.
The court said it did want to evaluate the merit of the case, it wanted to see whether anyone can be arrested this way on the basis of a GD.
"If a magistrate doesn't know it, he has no right to continue his job."
As the court asked the Deputy Attorney General whether any case was lodged, he said none was.
The other lawyers present at the courtroom gave their opinions that no one can be remanded unless a case was filed with specific charges.
On a complaint lodged by Shaon, Rapid Action Battalion on Monday arrested the physician on charge of threatening her on Facebook.
During primary interrogation Ehsanuzzaman admitted that he along with some of his friends created a group the social networking site, named "We Hate Meher Afroz Shaon" where they posted various comments insulting Shaon.
After the police produced him before the court of metropolitan magistrate SM Atiqur Rahman with a remand petition on Tuesday, the court granted two days to interrogate him in custody.
Ehsanuzzaman is a physician of Sunamganj Sadar Hospital and was appointed in public service through the 27th BCS examination in 2008.
