The
High Court on Thursday rejected a writ petition challenging the
legality of Suranjit Sengupta's appointment as a minister without
portfolio.The court passed the order on the ground that Suranjit was given the charge of a minister without portfolio not as a new minister, rather he was shifted from the railway ministry to the office of a minister without portfolio.
As a railway minister Suranjit had taken oath and now he needs not to take oath anew for holding the post of minister without portfolio, the court said during the hearing on the petition.
On October 1, Supreme Court lawyer Tuhin Malik filed a writ petition with the High Court, challenging the legality of Suranjit Sengupta's appointment as a minister without portfolio.
In the writ, Tuhin Malik claimed that there is no such post under the constitution.
The HC on Thursday also said Suranjit was not made a respondent in the writ petition which challenged the legality of his appointment.
The HC bench of Justice Naima Haider and Justice Muhammad Khurshid Alam Sarkar came up with the order after holding hearing on the petition.
After the court order, Tuhin Malik told The Daily Star that the office of the minister without portfolio has been given legality following the HC order.
He also said that he will move an appeal before the Supreme Court against the HC order.
