Writ seeking HC order to postpone Presidential poll

DHAKA: A writ petition was filed with the High Court Tuesday seeking directive to postpone next Presidential election.

Supreme Court lawyer Advocate Dr Yunus Ali Akand filed the writ on Tuesday.

He also sought HC rule about why section 70 should not be cancelled as it is conflicting with the constitution.

Secretaries to Cabinet, Law, Parliament Secretariat and Chief Election Commissioner (CEC) were made respondents to the writ.

Yunus Ali Akand said, “I came to know through dailies that the Members of Parliament will elect next President on April 22.

According to the section 70 of the constitution, voting against decision of party will annul membership of parliament.

Besides, no competent person can be candidate of the election out of any political party.

This is why he filed this writ seeking postponement of Presidential Election till the annulment of section 70, he said.

The hearing of the writ will be held with HC bench comprising Justice Kazi Rezaul Haque and Justice ABM Altaf Hossain.

Following the death of President M Zillur Rahman, Election Commission (EC) fixed April 22 to elect next president.

Some 349 Members of Parliament will elect the 20th President of the country on the day.
