On Sunday, the Bench led by Chief Justice Md Muzammel Hossain ruled
as valid the High Court's grant of bail and turned down a prosecution
plea to scrap them.
The four BNP leaders whose bail has been
upheld are Moudud Ahmed, Rafiqul Islam Mia, M K Anwar and the party
chairperson Khaleda Zia's adviser Shamshur Rahman Shimul Biswas.
A J Mohammed Ali led the defence.
State was represented by Deputy Attorney General Mohammed Sohrawardy.
He
later told bdnews24.com: "We appealed against the High Court's order
granting bail to these four leaders. The Appellate Division has upheld
the High Court's order."
These four leaders were arrested by
police on Nov 8 after the BNP called for a 72-hour strike against
holding the parliament polls.
They were booked for instigating violence in the aftermath of the May 5 police drive against the Hifazat-e Islam.
Later,
they were implicated in several other cases of bomb explosions, attacks
on police and instigation to set a bus on fire at Motijheel, in which
some passengers were killed.
A High Court bench of Justices Nizamul Huq and Jahangir Hossain granted these four leaders bail in both these cases.
These leaders still have three cases pending against them, in two of which they have all secured bail on Jan 26.
Moudud
Ahmed's lawyer Barrister Ehsanur Rahman said that Shimul Biswas has got
bail in a lower court in the last case and if the others manage bail in
that case, they would walk free.
